Workout Waiver and Release of Liability

This agreement is entered into between the parties:
Colacurcio Wellness LLC (DBA: Vitality Health Club) (hereinafter referred to as “the Club”) and (hereinafter referred to as “the Member”)

I, the Member hereby voluntarily request and agree to participate in the activities and programs offered by the Club, private and small group training, exercise / group fitness classes, nutritional counseling and hands on instruction of how to prepare healthy foods such as protein and fruit smoothies while using a blender, ping pong, boxing, kickboxing and the like, and infrafed sauna use. In consideration of being permitted to participate in these activities, I hereby agree to release, discharge, and hold harmless: the Club, its owners, independent contractors, employees, agents, and representatives from any and all claims, demands, actions, or causes of action, for any injury or damage to myself or my property arising out of or in connection with my participation in these activities.

I understand that the activities offered by the Club may involve risks and hazards, including but not limited to, physical injury, illness, property damage, heart attack, stroke, TIA, slip and fall, fainting and falling, sprains, strains, fractured bones, and concussions. I acknowledge that I am voluntarily participating in these activities with knowledge of the potential dangers involved, and I agree to assume any and all risks associated with my participation.

I further agree to indemnify and hold harmless the Club from any and all claims, suits, or actions of any kind arising out of my participation in these activities.

I understand that this waiver and release of liability will remain in effect for the duration of my membership with the Club.

I have carefully read this waiver and release of liability and fully understand its contents. I am aware that by signing this document, I am giving up certain legal rights, including the right to sue the Club, it’s owner(s), independent contractors, employees, agents, and representatives for any injuries or damages that may occur during my participation in its activities.
